This page tells you information about us and the legal terms and conditions (the “Terms”) on which you trade-in your Eligible Device using the Recycling Service provided by Likewize through the
trade-in website (the ”Site”) for the sole and limited purpose of processing the purchase of your Eligible Device.
The Recycling Service enables you to sell your used Eligible Device to Likewize for a cash price equivalent to the value of your Eligible Device as determined by Likewize dependent on its condition, which will be advised to you (as referred to in clause 6 below).
Therefore, by entering the details of your used Eligible Device, accepting the Terms, and sending the Eligible Device to Likewize for evaluation, you will be granting an irrevocable and confirmed instruction to Likewize that you wish to sell your Eligible Device and to authorize Likewize to remit the value to you (if any) by a bank transfer to your account or PayPal account details.
Any reference in these Terms and Conditions to money, payment, or any other form of remuneration from Us in exchange for your Eligible Device is to be understood as the purchase price which you may be entitled to.
These Terms will apply to any contract between Likewize for the trade-in of an Eligible Device by you (the ”Contract”).
Please read these Terms carefully and make sure that you understand them, before trading-in any devices via the Site.
Please note that before trading-in a Product or placing an order, you will be asked to agree to these Terms. If you refuse to accept these Terms, you will not be able to trade-in any device via the Site.
You should print a copy of these Terms or save them to your computer for future reference.

1.1. Likewize operates the Site and Recycling Service.
1.2. giffgaff Limited and its affiliates and subsidiaries (collectively “giffgaff”) are not party to the Contract between you and Us and you shall have no right of action against giffgaff for any breach of a Contract.
1.3. giffgaff hereby disclaims and excludes any and all warranties of any kind, express or implied. By using the Recycling Service, you hereby release giffgaff and its respective directors, employees, and agents from any disputes, claims, demands, and/or damages (actual or consequential) of every kind, whether known or unknown, arising out of, or relating to, your use of the Recycling Service, including, without limitation, incomplete or completed transactions and any claims or disputes between you and Likewize.
In order for Likewize to carry out the Contract for the purchase of your Eligible Device we will need your name, address, email address, telephone number, details of your account in which to remit the value of the Eligible Device, details of the Eligible Device and other limited information which we will request when you sign up to the Recycling Services via this Site.
We will use this information solely for the purposes of the Recycling Services and in fulfilling our contractual obligations, but for no other purpose unless you have agreed to any additional purpose.

3.1. The Site is made available free of charge. We do not guarantee that the Site, or any content on it, will always be available or be uninterrupted. Access to the Site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of the Site without notice. We will not be liable to you if for any reason the Site is unavailable at any time or for any period.
3.2. We do not guarantee that the Site will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform in order to access the Site. You should use your own virus protection software.
3.3. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.
3.4. You must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site. You must not attack the Site via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you may commit a criminal offence. Where a criminal offence has been committed we will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities and may disclose your identity to them. In the event of such a breach, your right to use the Site will cease immediately.
4.1. If you are a Customer using the Recycling Service, you warrant that:
a) You are at least 18 years old;
b) You are the sole owner of the device and/or have been authorised by the owner of the device to make decisions on the device and to trade it in and sell it and there are no other parties who have any interest or claim (liens, encumbrances or security interests) in or attached to the device including without limitation finance or hire-purchase agreement and that no other party has a legal interest in it;
c) The device is not counterfeit, stolen or fraudulent and otherwise complies with these Terms;
d) In using the Site and trading-in the Eligible Device, you are not infringing any intellectual property right of a third party;
e) You are resident in the United Kingdom and that you are accessing the Site from that territory; and
f) You are legally capable of entering into a binding contract with us.
4.2. You are responsible for cancelling any airtime contract linked to each device. Neither we nor giffgaff are not responsible for any call costs arising before, or after, receipt of your device or arising from any other circumstances whatsoever.
4.3. These terms and conditions shall not affect any statutory rights you may have as a consumer.
5.1. Each Eligible Device a customer sends to Likewize should match the make, model and condition stated when placing your offer to sell on the Site.
5.2. In order to provide a value for your Eligible Device (the “Initial Quotation”), before We receive the Eligible Device from you, you confirm that you have accurately described the condition of the Eligible Device on the Site.
5.3. The Initial Quotation is valid for fourteen (14) days from the date on which the price is issued to you on the Site.
5.4. All quotations and payments include VAT (as applicable).
6.1. To obtain an Initial Quotation, answer the questions regarding the condition of the Eligible Device.
6.2. Upon receipt of the Eligible Device, within the 14 day period in which the Initial Quotation is valid, Likewize shall inspect the Eligible Device and determine the condition. Where an Eligible Device is determined to not be in excellent cosmetic condition nor good working condition then a reduction in the Initial Quotation will be made and a Final Quotation shall be issued to you. Likewize shall reduce the price offered in accordance with the table below for the reasons outlined.

7.1. Nothing on the Site constitutes an offer by us to sell or purchase any goods or services.
Sending Eligible Devices to us shall constitute an offer by you to sell such Eligible Device to us in return for the Initial Quotation (“Your Offer”). However, please note that this does not mean that Your Offer has been accepted by Likewize. Our acceptance of Your Offer will take place as described in Clause 7.2.
7.2. No Contract will be formed until either:
a) we accept Your Offer, by paying to you a sum equal to the Initial Quotation;
b) you have accepted our Revised Quotation and we make a payment to you of a sum equal to the Revised Quotation; or
c) you fail to accept our Revised Quotation within 7 days of us supplying it to you. Following such date you are deemed to have accepted our Revised Quotation and we will make a payment to you of a sum equal to the Revised Quotation.
7.3. Title in the Eligible Device(s) shall pass to us on your acceptance of the final purchase price of such Eligible Devices at which point you disclaim any further right, title or interest in and to the Eligible Device or any items contained therein.
7.4. Subject to clause 7.5 below, risk in the Eligible Device shall pass to us once the Eligible Device is received by us via the mail/courier service that you use to send the Eligible Device to us.
7.5. Whilst the Eligible Devices are in transit from you to us the following shall apply:
a) for each Eligible Device that you send to us you shall ensure that: (i) it is packaged so that it is physically protected; and (ii) you obtain and provide to us on request a tracking number for the package;
b) we shall not be liable to you for any loss arising in connection with the loss or damage to an Eligible Device whilst in transit or otherwise within the domain of Likewize, should you fail to comply with the provisions of these Terms.
8.1. Once we receive the Device, we inspect it to ensure that it matches the description you initially provided to us (”Inspection”).
8.2. Provided the Device meets the terms of this agreement and matches the condition stated by you to receive the Initial Quotation, payment will be made to you by your chosen payment method and details provided by you on the Site.
8.3. The Inspection assesses the condition of the Eligible Device. If the model, condition or country of origin of the Eligible Device differs from the description originally stated by you, the Initial Quotation will be adjusted. If, as a result of the inspection, it is found that you have delivered us a different model from the one on which we applied the Initial Quotation value, we will quote you the market price for such other model on the basis of the price stated on this website on the date of receipt of such other model (the market price will vary depending on the condition of the device). If we decide to offer a value for one or more devices, we may adjust the original value.
8.4. We have sole discretion in determining the appropriate condition, model, country of origin and price of the Eligible Device.
8.5. If required in accordance with the provisions of these terms, we will contact you via email or text message to confirm the adjustment we have quoted for the Eligible Device (“Revised Quotation”). Within 7 days from the date we send you the email or text message, you decide whether to accept the Revised Quotation. We are not responsible for the failure of such emails to be delivered to you due to spam mail or junk mail filters. If you:
a) do not respond to an email or text message within 7 days it shall be deemed that you have accepted the Revised Quotation price for your Eligible Device, payment of the Revised Quotation value will be made to you via your selected payment method.
b) choose to decline the Revised Quotation value, the Eligible Device will be returned to you, within 10 business days. If, for any reason, we are unable to return your Eligible Device to you, we will pay you the Revised Quotation value. Exceptions are made where the failure to return your Eligible Device to you is caused by your actions or omissions. Any accessories, SIM or data card that you may have sent with your device shall not be returned to you.
8.6. If the Eligible Device is registered as lost or stolen, Likewize will retain it in accordance with the Recycler Charter. The Eligible Device will NOT be returned to you nor will there be any value given to the you unless you are able to prove the legitimate ownership of the Eligible Device within 28 days. It is the responsibility of Customer to inform Likewize that they are contesting this decision. If you are not able to prove the legitimate ownership of the Eligible Device, it will be treated in accordance with the Recycler Charter requirements.
8.7. Any devices that are sent to Likewize and do not have a value will be recycled in line with applicable regulations.
9.1. It is your responsibility to:
a) Remove any sim card (the “SIM”) and/or any memory card before sending your Eligible Device to us. The SIM and memory card can contain private information and may enable unauthorised use of your network airtime or your personal information. If you fail to remove the SIM or memory card, you agree to release us from all claims, losses or damages with respect to the use of the SIM or memory card arising before, or after receipt of your Eligible Device.
b) Delete and remove all personal files and data, whether in the form of personal details, SMS, photos, games, songs or other data (the “Data”) from the Eligible Device and reset your Eligible Device to factory settings. Always follow the manufacturer’s guidelines to wipe the data:
c) Likewize does not warrant or guarantee that resetting the Eligible Device to factory settings will permanently delete any Data or personal information from the Eligible Device. Likewize shall have no obligations in respect of wiping or removing the Data. Likewize accepts no responsibility for failure to maintain the integrity or confidentiality of any Data in the device.
9.2. Please remove any security locks and disable “find my Phone” functions before sending your Eligible Device to Likewize, if these are in place this will disable access to the Eligible Device and its value will be zero.
9.3. By sending your Eligible Device to us, you agree to release us from all claims, losses or damages with respect to the SIM, Data or Product. We accept no responsibility in relation to the security, protection, confidentiality or use of such Data or the SIM. You acknowledge that once we have Purchased the Eligible Device from you we may resell the Eligible Device to a third party, and we have no control over what the third party does with the Eligible Device or who they may resell the Eligible Device to. It is therefore vital that you follow the requirements set out in this clause 9 regarding the removal of your data and Content from the Eligible Device.
9.4. Please back up any data or other information and content you want to keep from the Eligible Device on a secure cloud based system or other data storage device (in accordance with the manufacturer’s recommended procedure) before sending the Eligible Device to Likewize. It will not be possible for you to obtain any Data or other content from the Eligible Device, whether stored on the device or memory card, once it has been sent to us.
9.5. You agree that you have the sole responsibility to keep a separate backup copy of any Data before sending your Product to us; and that you have taken all reasonable steps to eliminate and delete Data that is deemed personal or confidential from the Product. Data recovery is not a part of the trade-in service and we and giffgaff accept no responsibility or liability for any lost Data.
10.1. giffgaff Limited or Likewize (as applicable) are the owners of all intellectual property rights in the Site, and in the material published on it.
10.2. You may not modify the paper or digital copies of any materials you have printed off or downloaded from the Site in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
10.3. You must not use any part of the content on the Site for commercial purposes without obtaining a licence to do so from us or our licensors.
10.4. If you print off, copy or download any part of the Site in breach of these Terms, your right to use the Site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
11.1. This Recycling Service is provided for lawful purposes only, and Customer agrees to indemnify Likewize and any of their directors, officers, employees, affiliates, subsidiaries or agents from and against any claims brought against any of them arising from performing this Recycling Service on Customer’s behalf or for any breach of these terms and conditions by Customer.
11.2. Likewize will under no circumstances be liable for any special, indirect, incidental or consequential damages resulting from this Recycling Service.
11.3. To the extent permitted by applicable law, Likewize and their affiliates’ entire liability, if any, from any cause whatsoever with respect to this Recycling Service shall not exceed 100% of the market value of the device. These terms shall be governed under the Laws of England and Wales.
11.4. Each of the clauses of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
11.5. We may amend these Terms from time to time. Please look at the top of this page to see when these Terms were last updated and which Terms were changed.
11.6. Every time you trade-in an Eligible Product via this Site, the Terms in force at the time of your trade-in will apply to the Contract between you and us.
11.7.We may revise these Terms as they apply to your order from time to time to reflect the following circumstances:
a) changes in relevant laws and regulatory requirements; and/or
b) a change in our business practice.
11.8. If we have to revise these Terms as they apply to your order, we will contact you to give you reasonable advance notice of the changes and let you know how to cancel the Contract if you are not happy with the changes. You may cancel in respect of all of the affected Eligible Devices. If you opt to cancel, you will have to return any monies (or other consideration) you have already received.
Except to the extent provided by these Terms, if you are in receipt of any promotional incentives from giffgaff Limited that may be applied upon this Site all such obligations and liabilities for such promotion and or offer shall remain with giffgaff and not Likewize. The terms and conditions of any offers operated by giffgaff shall be found at giffgaff.com/terms/promotions. Any promotions offered by giffgaff are between you and giffgaff, Likewize shall have no obligation nor liability to you in respect of giffgaff offers and promotions.
